АDMINISTRATIVE AND LEGAL MODEL FOR ENSURING THE RESILIENCE OF ENTREPRENEURIAL ACTIVIT IN THE CONTEXT OF EUROPEAN INTEGRATION AND UKRAINE’S POST-WAR RECOVERY

Abstract

The article is devoted to a comprehensive study of the administrative and legal model for ensuring the resilience of entrepreneurial activity in the context of European integration, martial law, and Ukraine’s post-war recovery. It is substantiated that contemporary crisis-related challenges associated with the full-scale armed aggression of the Russian Federation against Ukraine, the transformation of the public administration system, and the necessity of adapting national legislation to the standards of the European Union necessitate a reconsideration of approaches to the administrative and legal regulation of entrepreneurial activity. It is determined that, under current conditions, entrepreneurship functions not only as an economic category but also as an important element of ensuring the economic security, social stability, and national resilience of the state. The study formulates the author’s approach to understanding the resilience of entrepreneurial activity as the ability of business entities, together with the legal and organizational environment connected with their functioning, to ensure the continuity of economic activity, adapt to destabilizing factors, and preserve their core functional characteristics under crisis conditions. The article proposes a definition of the administrative and legal model for ensuring the resilience of entrepreneurial activity as a systemic set of legal norms, institutional mechanisms, and administrative procedures aimed at creating a stable, predictable, and secure business environment. Particular attention is paid to the analysis of the impact of martial law on the mechanisms of administrative and legal regulation of entrepreneurial activity, as well as to the problems of fragmented legislation, instability of regulatory frameworks, and excessive administrative burdens imposed on business entities. The European integration dimension of the modernization of administrative law in the field of entrepreneurship is examined, particularly issues related to deregulation, digitalization of administrative procedures, implementation of the “one-stop-shop” principle, and the development of a service-oriented model of public administration. The article proposes a conceptual three-level model of administrative and legal support for the resilience of entrepreneurial activity encompassing the normative, institutional, and procedural levels. The necessity of supporting domestic producers, stimulating investment activity, and developing veteran entrepreneurship as priority areas of state policy in the context of post-war recovery is substantiated. It is concluded that effective administrative and legal support for the resilience of entrepreneurial activity constitutes one of the fundamental prerequisites for Ukraine’s economic reconstruction and its integration into the European legal and economic space.
