SELECTED ISSUES IN IMPROVING GENERAL SOCIAL PREVENTION MEASURES FOR CRIMINAL OFFENSES COMMITTED IN THE HEALTHCARE SECTOR IN UKRAINE

Abstract

The article analyzes certain problems of improving measures for the general social prevention of criminal offenses committed in the field of medical care in Ukraine. It is noted that the rudimentary nature of a number of criminal law norms has led to a distortion of society’s perception of the punishability and inevitability of punishment. Another negative aspect has been the complication of the work of law enforcement agencies. It is indicated that criminal offenses committed in the field of medical activity have their own characteristics, which, for the most part, consist in the fact that they are directly related to a specific type of professional activity. Accordingly, general social measures should cover not only the field of medical activity, but also the training of medical workers, the financing system, etc. The need to eliminate negative factors of a general social nature that are systemic in nature and create risks that can lead to the formation of a criminogenic environment in this area is indicated. One of such factors and factors is the lack of effective control over document flow and electronic document flow in the field of medical activity. It is determined that today in Ukraine, legal documents that would clearly regulate the procedure for documenting professional medical activities can be assessed as not fully effective. It is logical that this creates appropriate conditions and opportunities for entering false information. It is proven that it is appropriate to make changes to the Instructions for office management in the Ministry of Health of Ukraine, approved by the Order of the Ministry of Health of Ukraine dated February 25, 2014 No. 143 and the Procedure for using the electronic document flow system in the Ministry of Health, approved by the Order of the Ministry of Health of February 22, 2023 No. 358, namely to determine the mechanism for ensuring the confidentiality of personal keys of medical workers and the procedure for reporting their compromise.
