FORMATION OF THE PRACTICE OF APPLYING THE LAW OF UKRAINE “ON ADMINISTRATIVE PROCEDURE”: THE LEGAL POSITIONS OF THE SUPREME COURT

Abstract

The article examines the case law of the Supreme Court of Ukraine concerning the application of the Law of Ukraine «On Administrative Procedure» following its entry into force. The study outlines the background of the Law’s adoption, its principal innovations, and the implementation of general administrative procedure rules in the activities of administrative authorities. Particular attention is paid to the legal positions of the Supreme Court regarding the principle of proportionality, procedural safeguards, the concept of an administrative act, and the delimitation of judicial jurisdiction in disputes arising from the application of the Law. The author identifies the main trends in the development of judicial practice and concludes that the Supreme Court is gradually establishing consistent approaches to the interpretation and application of the Law, with increasing emphasis on procedural guarantees as an independent criterion for assessing the legality of administrative acts. At the same time, it is substantiated that the application of the Law has not yet become fully settled, and a considerable number of its provisions still require further judicial clarification. The article concludes that the legal positions of the Supreme Court play a significant role in ensuring the uniform application of administrative procedure legislation and identifies promising directions for further research, including the analysis of individual principles of administrative procedure, their practical implementation, and their influence on the activities of administrative authorities.
