Abstract

The article analyzes the problems of implementing the right to a fair trial in disputes about the protection of the rights of consumers of tourist services. In most cases, the consumer is the weak side of the contract for the provision of tourist services. Usually, when concluding a contract, the consumer depends on the information provided by the tour operator or travel agency, and does not have the opportunity to check all the terms of the contract and the compliance of the services with the declared parameters. Also, in many cases tour operators and travel agencies have more experience and resources than the consumer, which also makes the consumer less powerful. The protection of consumer rights in the field of tourism is a crucial issue due to the significant growth of the tourism industry and the resulting increase in the number of consumer disputes. Despite the existence of laws and regulations that aim to safeguard consumer rights, numerous challenges remain. This paper analyzes the main problems encountered by consumers when seeking legal protection for their rights in the tourism industry and proposes several solutions to address these issues. The topic of exercising the right to a fair trial in disputes about the protection of the rights of consumers of tourist services is relevant. In recent years, the number of consumers using tourist services has been increasing, so the number of disputes related to this field is also increasing. In addition, consumers are becoming increasingly aware of their rights and demand their protection in case of violation. In such cases, the realization of the right to a fair trial is important for the protection of the rights of consumers of tourist services. Firstly, the paper examines the issue of unequal bargaining power between consumers and tourism businesses, which leads to unfair contracts and practices. Secondly, it explores the difficulties consumers face when seeking access to justice and the need for simplifying legal procedures and promoting alternative dispute resolution mechanisms. Thirdly, the paper investigates the problem of slow and ineffective judicial processes, which hinder the enforcement of consumer rights. In order to tackle these issues, the paper suggests several measures, including strengthening consumer protection laws and regulations, promoting consumer education and awareness, providing access to affordable legal services, enhancing the efficiency of judicial processes, and encouraging the use of alternative dispute resolution mechanisms. The findings of this paper provide insights into the challenges faced by consumers in the tourism industry and the need for improving the legal framework and practical measures to protect their rights. The proposed solutions aim to contribute to the development of a fair and transparent tourism industry that benefits both consumers and businesses.
