THE LAWYER’S ROLE AS A DEFENDER IN CRIMINAL PROCEEDINGS

The article is devoted to research and analysis of the role of the defense attorney in criminal proceedings. Ensuring the right to defense is one of the fundamental principles of the modern criminal process. A lawyer as a defender plays a key role in the implementation of this right, because he is the one who provides legal assistance to a person who is suspected or accused of committing a crime. The research consists of a comprehensive approach to the analysis of the role of the defense lawyer in the criminal process, taking into account the modern trends in the development of criminal justice. The theoretical provisions and legislative acts regulating the activity of a lawyer as a defender are analyzed. The issue of the role of the defense attorney at various stages of criminal proceedings has been studied. It has been determined that his primary function is to ensure that the client’s rights are protected at every stage of the criminal process, from pre-trial investigation to sentencing. Special attention is paid to ways of confirming the powers of the defender, because it is precisely on this that the possibility of him properly performing his functions depends. The realization of the rights of the defender in the criminal proceedings and the grounds for his participation in the criminal proceedings are analyzed. The lawyer acts not only as a legal representative of the suspect or accused, but also as a guarantor of legality and justice during the entire process. The issue of mandatory participation of a lawyer in criminal proceedings has been clarified. The procedural procedure for admitting a defense attorney to participate in a criminal case has been studied. The admission of a defense attorney to participate in a criminal case is a guarantee of the right to defense, which is enshrined in the Constitution of Ukraine. This right is essential to ensure a fair trial, protection against unjustified prosecution and violation of rights. The legal status of a lawyer in criminal proceedings, his rights and duties are revealed. The defender carries out his activities regardless of any influence. A complex of problems faced by lawyers in modern conditions is considered. Despite numerous challenges, lawyers continue to do their important work, guaranteeing access to justice for all.
