EXTRADITION IN CRIMINAL PROCEEDINGS

The article examines the legal nature of the institution of extradition in criminal proceedings, its regulatory and legal regulation and practical aspects of application. The concept and essence of extradition, its types and forms, as well as the grounds and conditions for implementation are revealed.The relevance of the problem of extradition of persons in the context of international cooperation in the fight against transnational crime is determined. The legislative acts of Ukraine and international treaties are analyzed.The concept of extradition is revealed as a legal mechanism aimed at the extradition of persons who have committed criminal offenses for the purpose of their criminal prosecution or execution of the sentence.The mechanisms of temporary and extradition arrest, the features of the simplified extradition procedure, as well as the problems arising in the process of international cooperation in the field of extradition of persons are considered.Special attention is paid to the classification of extradition procedures into general and simplified procedures, their stages, features and grounds for refusing to extradite a person are described.The article also analyzes the research of domestic scientists, analyzes the function of extradition and the grounds in criminal proceedings, stages and basic principles of extradition. The functional aspects of extradition are also considered: general (normative, implementation, international diplomatic) and special (protective, regulatory, law enforcement). The work is based on the provisions of the Criminal Procedure Code of Ukraine, international legal acts and scientific sources, which allows us to draw conclusions about the effectiveness and problems of extradition practice in Ukraine. The conclusions suggest ways to improve Ukrainian legislation in the field of extradition, which include simplifying extradition procedures, strengthening judicial control and compliance with international standards in the field of human rights.
