RESPONSIBILITY FOR DOMESTIC VIOLENCE AND MECHANISMS FOR ITS PREVENTION UNDER THE NATIONAL LEGISLATION OF UKRAINE

The article provides a comprehensive analysis of the legal mechanisms of legal liability for domestic violence in Ukraine and examines the effectiveness of preventive measures to prevent it. The author investigates administrative liability under Article 173-2 of the Code of Ukraine on Administrative Offenses and the corresponding provisions of the Criminal Code of Ukraine (Article 126-1). The article analyzes law enforcement and judicial practice, and analyzes statistical data of the National Police of Ukraine for the period 2023–2025, including data from territorial police units of the Ternopil region. Attention is drawn to the impact of martial law on the dynamics of appeals and the implementation of preventive/ precautionary measures. Special emphasis is placed on the peculiarities of law enforcement in cases involving military personnel, as well as the problems of victims’ access to assistance in difficult socio-psychological conditions. The author justifies the need for a comprehensive approach that combines legal, social, and psychological mechanisms for preventing domestic violence, and suggests directions for improving preventive programs adapted to modern challenges. The article also examines key preventive and protective measures for combating domestic violence, including the application of emergency and restraining orders, placing the perpetrator on preventive supervision, conducting corrective and preventive work with the offender, and referring them to specialized intervention programs. These mechanisms help reduce the risk of repeated violence and enhance the level of protection for victims. In the conclusions, the author proposes improving legal norms and their practical application, in particular by lowering the threshold of “systematic” behavior required to bring a perpetrator to criminal liability under Article 126-1 of the Criminal Code of Ukraine. The study also emphasizes the need for a comprehensive approach to the prevention of domestic violence. Special attention is given to adapting preventive programs and mechanisms of interaction with offenders under complex socio-psychological conditions, including martial law, which enhances the effectiveness of response measures and reduces the risk of repeated violence.
