THE CONCEPT OF HUMAN SECURITY IN THE AXIOLOGICAL DIMENSION: PHILOSOPHICAL AND LEGAL ANALYSIS

Abstract

The article provides a comprehensive philosophical and legal analysis of the concept of human security in the axiological dimension. The value foundations of human security as a complex phenomenon combining material and spiritual aspects are analyzed. The methodological basis of the study is a complex of general philosophical, general scientific and special legal methods of scientific knowledge. The starting point is the axiological approach, which allows us to consider the concept of human security as a value-based phenomenon of legal and social reality. Within the framework of this approach, human security is analyzed not only as an instrument of public policy, but as a normative-value category associated with human dignity, freedom and justice. The application of the philosophical and legal method made it possible to identify the ontological and normative foundations of the concept of human security in modern legal understanding. In general, the applied methodology provides a holistic and substantiated study of the concept of human security in the axiological dimension and allows us to reveal its philosophical and legal significance in modern legal discourse. It is substantiated that human security goes beyond the traditional understanding of security as an element of state or military policy and appears as an independent fundamental social and legal value, closely related to the ideas of human dignity, freedom, life, inviolability and autonomy of the individual. It is shown that the concept of human security forms a human-centric paradigm of legal understanding, within which the state is considered not as an end in itself, but as an instrument for ensuring conditions for a dignified and safe existence of a person. Special attention is paid to the axiological potential of the constitutional provision on the recognition of a person as the highest social value as the normative basis of the concept of human security in the national legal order. The thesis is substantiated that human security is an integral value that determines the meaning and purpose of the modern legal system. The article reveals the relationship between different levels of security and the system of values of society, and also analyzes the axiological determinants of the legal provision of human security. It is proved that the integration of the axiological principles of human security into legislation and law enforcement practice contributes to strengthening human rights guarantees, increasing the level of social trust and harmonizing the national legal system with European standards. It is concluded that the concept of human security serves as an important value guideline for the development of modern law in the context of global challenges, social instability and transformation of legal systems.
