ACTIVITIES OF THE STATE BUREAU OF INVESTIGATIONS IN THE FIELD OF COUNTERING CORRUPTION AS AN OBJECT OF SCIENTIFIC RESEARCH

Abstract

The purpose of the article is to form a holistic scientific understanding of the activities of the State Bureau of Investigation in the field of combating corruption as an independent object of scientific research, to clarify its place in the system of subjects of anti-corruption activity, as well as to identify problematic issues of legal regulation and the practice of implementing relevant powers. The article is devoted to a comprehensive scientific understanding of the activities of the State Bureau of Investigation in the field of combating corruption as an independent object of scientific research within the administrative and criminal law of Ukraine. The author analyzes the historical and legal prerequisites for the creation of the State Bureau of Investigation, reveals its regulatory and legal status, competence and functional purpose in the system of subjects of anti-corruption activity. Special attention is paid to the analysis of statistical indicators of the effectiveness of the State Bureau of Investigation for 2018–2024, in particular regarding the identification of unfounded assets, the return of funds to the state and interaction with the defense forces. The mechanisms of interaction of the State Bureau of Investigation with the National Anti-Corruption Bureau of Ukraine, the Specialized Anti-Corruption Prosecutor's Office, the National Agency for Corruption Prevention and other institutions were studied. It was found that the legal regulation of the anti-corruption activities of the State Bureau of Investigation is of a complex, interdisciplinary nature, as it combines the norms of criminal, criminal procedural, administrative and civil procedural legislation. At the same time, it is worth noting that there is currently no special law that would comprehensively regulate the anticorruption function of the State Bureau of Investigation, and the relevant powers are dispersed among several regulatory legal acts, which complicates both law enforcement activities and the scientific generalization of the practice of their implementation. Problematic aspects of legal regulation and organizational support of the activities of the State Bureau of Investigation were identified, and proposals were formulated to improve the current legislation in order to increase the effectiveness of combating corruption offenses. A conclusion was made about the need for further scientific study of the institutional status of the State Bureau of Investigation, taking into account the Asset Recovery Strategy for 2023–2025.
