Abstract

The article analyzes the impact of administrative and legal regulation on the effectiveness of the rehabilitation procedure for insolvent enterprises. Rehabilitation is considered as a set of measures aimed at restoring the solvency of enterprises and satisfying creditors’ claims. The author studies the key aspects that determine the success of the rehabilitation process, including restructuring planning, management decisions and legal support. The author defines rehabilitation as a system of measures that includes both organizational and financial aspects. The author emphasizes that the rehabilitation plan is the central document that regulates all actions within the rehabilitation process and describes in detail the measures aimed at restoring the functional capacity of the enterprise. The author studies international experience, where restructuring is an ongoing process that helps enterprises to adapt to changing market conditions and increase their competitiveness. The author describes how administrative and legal regulation ensures the implementation of restructuring through organizational, financial and legal measures. The article also examines the process of managing labor relations in the context of reorganization. In particular, the author analyzes the requirements for consultations with trade unions and social security of employees dismissed in the course of reorganization. The article also touches upon the importance of adapting to changing market conditions that require a flexible approach to rehabilitation and restructuring. The author emphasizes that the implementation of the rehabilitation plan should be aimed at achieving real results, including changes in the management and financial structures of the enterprise. Finally, the article emphasizes the importance of developing institutions to support the implementation of rehabilitation plans, including training and support for rehabilitation managers, as well as ensuring social stability and protecting the interests of all parties involved in the rehabilitation process.
