INTERNATIONAL EXPERIENCE IN LAND MARKET REGULATION: OPPORTUNITIES FOR UKRAINE

The purpose of the article is to explore the international experience of land market regulation and to identify opportunities for its adaptation in Ukraine, taking into account modern economic, legal, and social challenges. The study examines the experience of European Union countries – France, Germany, Poland, the Netherlands, Spain, Sweden, Italy, and the United Kingdom – regarding the legal regulation of agricultural land turnover. The research is based on comparative-legal, systemic, and analytical methods. The comparative approach made it possible to identify common trends and specific features of land market functioning in various countries, while the systemic approach allowed for the assessment of state regulation efficiency. The method of legal modeling was applied to develop proposals for improving Ukrainian land legislation. For the first time, the article provides a comprehensive analysis of international mechanisms of land market regulation and identifies directions for their possible implementation in Ukraine. The paper substantiates the expediency of establishing institutions similar to the French SAFER agencies to control the agricultural land market. It also highlights the potential for developing the cadastral system, introducing risk management tools, and strengthening state support for farmers. Particular attention is given to the “effective owner” principle, which envisages the allocation of land to those who actually cultivate it and contribute to local community development. The analysis of international experience demonstrates that Ukraine should integrate European principles of land governance with its national socio-economic context. It is proposed to enhance state supervision over the agricultural land market, prevent speculative transactions, and ensure transparency and public participation in decision-making. The implementation of EU best practices will foster the creation of a transparent, sustainable, and socially oriented land market in Ukraine, contributing to rural development and long-term economic growth.
